The Macomb Daily reports that a judge has declared a mistrial in a manslaughter case in Michigan because the state allowed a witness to falsely and improperly testify against the defendant.

Judge Mary Chrzanowski dismissed the case “with prejudice,” meaning that the state cannot retry defendant Dylan Childers unless her ruling is overturned by an appellate court.

The Macomb Daily reports that Chrzanowski ruled that the police investigator “falsely and improperly testified that Childers had a conviction for marijuana possession and improperly testified he was involved in a prior accident.” She found that assistant Macomb County prosecutor Paul Bukowski committed misconduct when he deliberately encouraged the prejudicial testimony.
